Reflexiones sobre precedentes del sistema matrimonial español en clave de libertad e igualdad

⟶ Resumen Los precedentes normativos del sistema matrimonial español ponen de relieve hasta qué punto el modelo de relaciones Estado-Iglesia católica, existente en cada momento histórico, ha obstaculizado la profundización de la libertad y de la igualdad aplicables a la celebración del matrimonio y a su jurisdicción. Según esos precedentes, el menor nivel de protección de estos derechos se alcanzaba en la medida en que el modelo de relaciones se conformaba como un Estado confesional católico fuerte y se regulaba el matrimonio canónico como el único matrimonio con efectos civiles. Su mayor nivel de protección se lograba, en cambio, cuando el modelo relaciones se aproximó, fugazmente, al de un Estado laico, en cuyo ordenamiento se reguló el matrimonio civil como el único matrimonio con efectos civiles. ⟶ Palabras clave Modelo de relaciones    Matrimonio civil    Matrimonio canónico    Sistema matrimonial    ⟶ Abstract The regulatory precedents of the Spanish matrimonial system highlight the extent to which the model of relations between the State and the Catholic Church, existing at each historical moment, has hindered the effectiveness of freedom and equality applicable to the celebration of marriage and its jurisdiction. According to these precedents, the lowest level of protection of these rights has traditionally been achieved to the extent that the model of relations has been a strong Catholic confessional state, and canonical marriage has been regulated as the only marriage with civil effects. On the other hand, the highest level of protection was achieved when the model briefly resembled that of a secular state, in whose legal system civil marriage was regulated as the only marriage with civil effects. ⟶ Keywords Relationship model   Civil marriage   Canonical marriage   Matrimonial system Volver
